Coming out of work today, some old woman in a 54 plate rover 25, pull out infront of me, i served to avoid her, then had to cut back in because of a car coming in the other direction, and she clipped my rear quarter, i left a nice rubber mark on her bumper, where as she has nicely gouged my arch. She now isnt accepting responsability, saying, "its my word against hers" and "you wernt there when i looked" and contradicting herself "you came up there quite fast" so she either didnt see me, or just pulled out infront of me.

nope im not having any lick at all!, and no i diodnt get her insurers details, i got her name, adress, and car reg. she didnt take any of mine. |

well thats fairly cut and dry tbh, theres no way you could cause that damage unless you were travelling down the road sideways.
(i assume you werent on this occasion)
you were on the main road, she was on the side road, she drove into the side of you. end of. |

If I was you I'd also blame the damage to your sideskirt on her - see if you can get it all repaired on the insurance?
Rule number 1 - whitnesses - should have flaged down the guy behind you/her etc first of all. People always deny liablity (in fact, insurance companies encourage it!).
